Family and Domestic Law — When to Seek Counsel

Divorce can be one of the most difficult times in someone’s life.   It affects not just the spouses that are separating, but entire families. Given the complexity of a divorce, it is important to seek legal counsel to understand all aspects involved in the procedure and have the best representation. The family law attorneys at Craige Jenkins Liipfert & Walker LLP will help guide you through the process.

Craige Jenkins Liipfert & Walker attorneys David Niblock, Susan Ryan and Amanda Creamer Gargis offered insight into family law that will help those facing this situation.

Family law encompasses many areas. What does Craige Jenkins Liipfert & Walker offer clients seeking counsel?

We specialize in all areas of family and domestic law including divorce, child custody, child support, post separation support and alimony, property distribution, adoption, guardianships of minors, paternity questions, and premarital agreements. We tailor our representation to our clients’ individual needs.  If separating spouses can agree on all of the issues surrounding their divorce, we assist our clients in negotiating and entering separation agreements that are fair and in our clients’ best interests.  If an agreement is just not possible because of a particular situation, we are here to guide our clients through mediation and the court system where individuals absolutely need attorneys to guide them and to represent them fairly and aggressively.

What are the most important things to consider when choosing a family lawyer?

When choosing a family lawyer, it is always important to consider the attorney’s level of experience and his or her knowledge of the law. But, equally important is your relationship with your attorney, and your ability to communicate well with your attorney. It is vital that you feel comfortable talking to your attorney, that the attorney knows all of the facts surrounding your case and that the attorney understands your goals, needs and expectations. Once your attorney knows your background, he or she can offer the best advice for your unique situation.  Our attorneys will always describe your rights and responsibilities and present you with your options to best achieve your goals.

How soon should someone seek legal counsel when going through divorce involving custody issues?

If you are considering separating from your spouse, it is important to understand your rights with regard to custody and to understand the possible outcomes of a conflict over custody. It is also important to keep the best interests of a child or children at the forefront at all times. If possible, seek advice before you even separate so that you do not unintentionally damage an otherwise strong claim for custody. If that is not possible, certainly try to consult an attorney as soon as possible after separation to ensure that your rights and your children’s rights are protected throughout the process.

How long can the legal process be from start to finish for divorce, custody and child support to be settled?

Parties are required to be separated for one year before they can file for a divorce, but during that time, they can move toward a resolution of all of their issues, including child custody, child support, alimony and property distribution. Depending on the complexity of the situation and the willingness or ability of the parties to negotiate, settling issues surrounding a divorce can be relatively quick or painfully slow.
